Two days ago I had an awful thought go through my mind while eating my dinner and it put a pit right in my stomach. This was before Stanford spoke up about his affair and I've been thinking about it ever since. Has anyone though that maybe all this helmet crap going here (and I'm sure that the "Take May Back" people and City politicians are sending feedback to the state politicians) could possibly trigger a state mandatory helmet law? Even if in the Supreme Court finds the Helmet Ordinance unlawful and it's taken off the books and all the charges are dropped what's stopping the law makers from saying it's time for a state wide helmet law in the near future?

It's a consideration, and there could be such an effort, but probably not successful.
First of all, and especially if the MB helmet law is struck down, politicians at the state level would likely realize that a helmet requirement is not popular overall and it's more possible to COST them votes at re-election time. Especially if the MB helmet law is struck down and the reason for it was shown/proven to have been a major element of an ANTI-BIKER movement versus and real "safety" considerations/justification claim. Second, the current state legislature seems rather biker-friendly overall.
For example, look at the red light malfunction law passed last year that allows MOTORCYCLES (only) to proceed through a light-controlled intersection after reasonable time if the light doesn't change for them - basically treating the light like a stop sign.
Those legislators KNEW that law would be misstated, misunderstood and misperceived as "letting bikers run red lights" - and that's EXACTLY what happened in the media and throughout much public discussion.
However, those legislators ALSO stuck to their guns and passed the law - disregarding the FALSE impressions and claims about the law that they faced - and did the RIGHT THING to pass the law REALLY applied and as it now stands.

We in Pa have the same type of "red light" law for motorcycles only. But there was not the outcry as you stated. It passed with no fanfare and we are happy about it.
Our state is the same as yours. We have the right to choose to wear or not! And like you said range, I don't see that changing too soon.
Also, since 90% of SC IS biker friendly and the weather IS warmer year round and more people own bikes, they will not change the law in the near future due to fear of losing votes.

Like I said it was only a thought that ran by me and Range brings up a good point about the Red Light Law they passed for motorcycles last year. Judge Toal didn't seem too pleased with what the City of Myrtle Beach was doing with their ticket issuing and court procedures all relating to probably a unlawful helmet ordinance. So maybe we have friends in high places, I'll keep my fingers crossed!

hey I read somewhere the other day, Biker Mag i think, that Nc passed first read on dropping mandatory helmet for over 21. Anyone heard anyhting on that? Would love to see it happen. With all insurance companies in financial crisis would be the perfect time. They arent going to put out the $$ to fight it.

I have asked opinions several times about the helmut law and many are not even concerned about it. I have been told it comes up every year or 2 one of the sen's or reps has the great idea to protect us from ourselves and it dont even get much attention so I would'nt worry too much about it..

MB City Commerce has already said they will send out notices stating they want full State helmet law .. Would not want to be the one to make it happen...
