Isn't deadline 1st week of March so we should hear something this week... If not need start phone and email chain to get them moving...

Don't ya'll think they are waiting as long as they so as to kill any chance of a decent spring rally here? Plus the city has plenty of time to plan their next attack. I'm just sayin...

What Train said. No doubt in my mind, there are 2 big things to consider here: 1. They are CAREFULLY crafting the text of their opinion. There are surely some points in their decision that will be quite clear and straightforward - and other points where you'll likely see a message where you'll have to "read between the lines" (like Justice Beatty's now-famous comments made during the hearing). 2. The SC Supreme Court DID agree to take this case in an ACCELERATED mode - bypassing many traditional and LENGTHY steps and actions you'd see before a case reaches them for their interpretation, evaluation, and determination. Though it's very normal to get impatient, I feel we should respect that the SC Supreme Court shifted some priorities for this. Taking longer to receive an announced decision is an acceptable trade-off for having the issue quickly addressed at such a high level.

Some of the delay may be that the way that the justices craft their decision will likely have many ramifications well beyond the wearing of a motorcycle helmet.
I'll bet that they wish that the issue of local helmet laws was the end-all of this case.
Realize that the decision will probably have an effect on many of the ways that the state and it's subdivisions interact with each other. Improperly done a maxi size can of worms will be opened and years of additional court hearings might ensue.

The longer they take, the better news I suspect it is for advocates of liberty. Myrtle Beach clearly over-stepped their authority in a number of ways. Some of their actions conflict with SC state law. Some of their actions conflict with the SC state constitution. Some of their actions conflict with the federal constitution (beyond the purview of the SCSC but they are not unaware).
If they were going to support the city, I would have expected a speedy decision that maintains the status quo. If they were going to simply strike down a city ordinance, I would likewise have expected a fairly rapid opinion. If they are planning to establish a significant legal precedent, then I would expect them to take their time.
So, IMHO, the longer they take the harsher the decision is likely to be for the petty tyrants of Myrtle Beach.

I got word of something last night that confirmed one of my suspicions - though I can't confirm it has actually happened. The SC Supreme Court has several special offices and counsels at its disposal. The city of Myrtle Beach and its municipal court system are NO STRANGERS to the wrath of them. In fact, one case in which I participated just happened to have local attorney Thomas C. Brittain (name sound familiar, fellow bikers & others concerned about the recent Myrtle Beach election's campaign financing?) representing a Myrtle Beach city official who was publicly reprimanded by them after being suspended (then REMOVED) from office, sentenced to two years' probation and being fined. Possibly, while the court is composing its opinion, it has requested one of the special offices to investigate and confirm that no CONTESTED helmet ordinance charge has gone to TRIAL yet - AND WHY none have gone to trial. This could possibly generate one or more violations of the Canons of the Code of Judicial Conduct by the City of Myrtle Beach municipal court - which makes the case even more complex but sure doesn't fare well for the city either...

I will pass it on to you via email or private message... The person is no longer in the position - in fact, The SC Supreme Court barred him from seeking or holding any other position like he had.

I wonder what MB is planning on after the decision?? Guess they will be at the city limits with a broom stick checking for baffles then pulling out the DB meter on those who dont..

This is only my opinion but there were massive bikes from Ormond Beach to Key West. I was advised by the Locals in Islamorada ( Florida Keys ) that they have never seen so many Bikers. There were Bikers Welcome going up at a lot of Restaurants in the Keys. Everyone I talked to that was a Local Resident or business owner in the Keys said bring it on. There were billboards from the Rossmeyer Family thanking the attendee's of the Spring Rally and some farther down the coast from the Chamber of Commerce. After spending 9 days in Florida and having doors opened and being thanked every where I went by both local residents and business owners why would anyone want to come here and be treated like Gary. We all know Gary and as such know he would do nothing, let me Repeat, HE WOULD DO NOTHING TO GENERATE THAT TYPE OF RESPONSE. Again this is 0nly my opinion but I feel the Rallies are DEAD and OVER in MB and the Marathon is likely to follow suit. RIP As a side note there were adds daily in the Florida Keys advertising MB. The people I talked to said they have no interest. I can only assume that the Chamber thinks people wanted to come north to experience the colder climate. While it is true that the golf courses in the Keys are only for the most part 9 holes even the golfers I talked to just laughed.

Now, I don't know about the rest of you - but THAT ("having doors opened and being thanked every where I went by both local residents and business owners") happened quite a bit HERE to me UNTIL the TakeBackMay crowd and the City of Myrtle Beach "lumped" us together with the "BikeFest" crowd in order to get rid of THEM.
