Dilligaf1, You really are Da Man, Very interesting memo, IMHO, and bear in mind I am not an attorney, The laws that Mayor Toads and the City Clowncil passed are an abuse of home rule and is a violation of section V of the state constitution, Specifically, State Uniform Judiciary. I wonder, How high will the taxes be raised to pay for the Law Suits that will follow? ? And who will file these suits?

Before everyone starts celebrating, the SC Supreme Court said the administrative hearings are unconstitutional (most likely because of it's lack of due process) and these "infractions" need to be held in city court. I'll start celebrating when these ordinances are struck down by the SCSC.
Just my two cents....

Well I went a step further and sent a e-mail to the director that sent the memo as her e-mail was on the memo. Here is what I sent
Mrs Frierson, I am actually unsure about how to proceed with this. I am writing pertaining to the memorandum sent out by Justice Toal pertaining to the administrative courts and what is going on in Myrtle Beach. I am writing in support of thousands of motorcycle enthusiast in the state of SC. they have passed "Local ordinances" to deter the operations of motorcycles within their city limits such as noise laws that are more strict than the state noise limits. They have also enacted a local ordinance requireing the use of helmets by riders over the age of 21 to come into their town. The SC law says riders over 21 have the choice not to wear one. I guess I am asking if you or Justice toal could provide an opinion on these laws or "ordinances" as they are supposed to be heard by a administrative hearings court starting April 24,2009. And if they can supercede state laws on the noise and helmet issues. Thank You very much for your time to read this,

Good email, dilligaf!! Steve Porter on WRNN was saying that this memo was "just one person's opinion" and didn't mean anything yet. Yeah, well, maybe, but this "one person" just happens to be the chief justice of the state of South Carolina's Supreme Court.

Here's what I see happening now....an injunction stopping the city from having Kangaroo court, Then the city redoing the helmet issue to make it an infraction that falls into its normal court or saying it just isn't worth the effort over a helmet..(they coming anyway0 and then at election day people seeing what the mayor did to the economy of Myrtle Beach in 09..they get rid of him and in a hundred years people look back and say "What a Toad" and then the leaders still try to figure out how to control ABBW which has been the issue all along.

The receipt saying it has been read arrived at 345pm so maybe I will actually get a reply. Due to not getting a rapid prefabricated response hopefully they are looking into it time will tell....
